Terms of Service
Effective October 17, 2026
These Terms of Service (“Terms”) govern your use of FirstNear (the “Service”), operated by [Company legal name] (“FirstNear”, “we”, “us”). By starting a trial, paying for the Service or using it, you agree to these Terms. If you use the Service for a business, you confirm you have authority to bind that business.
1. What the Service does
FirstNear helps local businesses get found on Google Maps, Google Search and AI assistants. Depending on your plan, this includes:
- a scan of your Google Maps rank from 49 points around your business, repeated weekly;
- improvements to your Google Business Profile, which you approve before we publish them;
- regular posts on your Google Business Profile and replies to your reviews;
- a review link and QR code you can share with your customers;
- setting up and keeping in sync your listings on other platforms such as Yelp, Apple Maps and Bing;
- a monthly check of what AI assistants (such as ChatGPT, Gemini, Claude and Perplexity) recommend in your area;
- weekly emails and a monthly report with data from Google, such as calls, bookings, direction requests and website clicks.
We may improve, change or remove features over time. We will not materially reduce what your plan includes without telling you first.
2. No guaranteed rankings or AI recommendations
Rankings on Google Maps and other platforms depend on many factors we don’t control, including the searcher’s location, competitors and each platform’s own systems. We do not promise any specific position, including “#1”, and we do not promise any number of calls or customers.
No one can promise what an AI assistant will say. We give AI assistants every reason to recommend your business, and we check what they say every month, but we cannot control their answers.
3. Your account and access to your profiles
- You must be at least 18 and the owner, or an authorized manager, of each business and profile you connect.
- To do the work, you give us access to your Google Business Profile (by connecting your Google account or adding us as a manager) and, where needed, to your other listings. You stay the owner and can remove our access at any time.
- You are responsible for keeping your login details safe and for the accuracy of the information you give us.
4. Free trial
New customers get a 3-day free trial. We ask for a payment card to start. If you don’t cancel before the trial ends, your subscription starts automatically and your card is charged on day 4. You can cancel during the trial at no cost. One trial per business.
5. Plans, prices and billing
- The Service is billed per location. The standard price is $99 per month for your first location and $69 per month for each extra location of the same business. Businesses with 10 or more locations can ask us for a custom price.
- Founding price: the first 20 businesses pay $79 per month for the first location and $59 per month for each extra location, for as long as their subscription stays active without interruption.
- Annual plans are $990 per location per year, paid upfront.
- Subscriptions renew automatically each month (or year) until cancelled. Payments are processed by Stripe. Prices are in US dollars and exclude any taxes, which we add where required.
- We may change prices for future billing periods with at least 30 days’ notice by email. Founding prices are not affected.
- If a payment fails, we may pause the Service until it is resolved.
6. Cancellation
There is no contract. You can cancel at any time from your account in two clicks. Your subscription stays active until the end of the period you already paid for, and you won’t be charged again. Apart from the guarantee below, payments are not refundable.
7. 60-day money-back guarantee
On day 1 we scan your Google Maps rank from 49 points around your business for your main search term. If your average position across those 49 points is not better on day 60 than on day 1, we refund everything you paid for that location. To qualify:
- your subscription must stay active for the full 60 days;
- we must keep access to your Google Business Profile for the full period;
- you must approve or reply to our proposed profile changes within 7 days of receiving them;
- the comparison uses the same search term, location and 49-point grid as the day-1 scan;
- it does not apply if your profile was suspended, moved, renamed or recategorized, or if rankings dropped because of actions outside our work (for example fake reviews, policy violations or changes you made without us);
- you must request the refund by email within 14 days after day 60;
- the guarantee applies once per business.
8. Your responsibilities
- Give us accurate information about your business, services, prices and hours, and tell us when they change.
- Only send us photos and content you own or have the right to use, and allow us to publish them on your profiles.
- Share your review link with all your customers, not only happy ones. You must not buy, write or ask for fake reviews, or offer rewards in exchange for reviews. These practices break platform rules and the law (including FTC rules in the United States), and we will not take part in them.
- Follow the rules of each platform we work on for you, including Google’s Business Profile guidelines.
9. Content we create
We write posts, review replies and profile text for you, using our team and AI tools. During your first month, we publish profile changes only after you approve them. You can review, edit or remove anything we publish. Once published on your profiles, that content is yours to keep, including after you cancel.
10. Third-party platforms
The Service works with platforms we do not own, such as Google, Apple, Yelp, Microsoft Bing, OpenAI, Google Gemini, Anthropic and Perplexity. FirstNear is not affiliated with or endorsed by any of them. Their own terms apply, they can change their rules or products at any time, and we are not responsible for their decisions, such as suspending a profile or removing a review.
11. Acceptable use
You may not use the Service for illegal, misleading or harmful purposes, to impersonate another business, or to try to access other customers’ data or disrupt our systems. We may suspend or end your access if you do.
12. Our intellectual property
The Service, including our software, reports, design and brand, belongs to [Company legal name]. You may use reports we send you for your own business. You may not copy, resell or reverse-engineer the Service.
13. Disclaimers
Apart from what these Terms say, the Service is provided “as is” and “as available”. To the extent the law allows, we disclaim all other warranties, including fitness for a particular purpose. Data from third-party platforms, such as rankings and performance figures, may be delayed or inaccurate.
14. Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential losses, such as lost profits, lost customers or lost data. Our total liability for any claim related to the Service is limited to the amount you paid us in the 3 months before the claim arose.
15. Indemnity
You agree to cover our reasonable costs if a third party makes a claim against us because of content you gave us, the information about your business, or your breach of these Terms or of a platform’s rules.
16. Ending the Service
You can stop using the Service at any time by cancelling. We may end or suspend the Service if you seriously or repeatedly breach these Terms, with notice where reasonable. When the Service ends, we stop working on your profiles and you should remove our access. Sections 2, 7 (for refunds already due), 12, 13, 14, 15 and 18 continue to apply.
17. Changes to these Terms
We may update these Terms. If a change is material, we will email you at least 30 days before it applies. Continuing to use the Service after that date means you accept the new Terms.
18. Governing law
These Terms are governed by the laws of [State], United States, without regard to conflict-of-law rules. If you are a consumer, you keep any rights the law of your country gives you that cannot be waived.
